1. Acceptance of Terms

By accessing and using Vocara ("the Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Service.

2. Description of Service

Vocara provides a digital language learning platform that enables users to learn vocabulary through spaced repetition, pronunciation guides, and personalized learning paths. The Service may be accessed through web browsers and mobile applications.

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service.

3. User Accounts

To access certain features of the Service, you may be required to create an account. You agree to:

  • Maintain and promptly update your account information
  • Maintain the security of your password and account
  • Accept responsibility for all activities that occur under your account

You are granted a limited, non-exclusive, non-transferable license to access and use the Service for personal, non-commercial purposes. This license does not include:

  • Any resale or commercial use of the Service or its contents
  • Any derivative use of the Service or its contents
  • Any downloading or copying of account information for the benefit of another merchant
  • Any use of data mining, robots, or similar data gathering and extraction tools

6. User-Generated Content

Users may be able to submit, upload, or post content to the Service. You retain ownership of any content you submit, but you grant Vocara a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, adapt, publish, and display such content for the purpose of providing and improving the Service.

You represent and warrant that you own or have the necessary rights to submit the content and that your content does not violate any third party's rights.

7. Subscription and Payment

Certain features of the Service may be provided for a fee. You agree to pay all applicable fees as described in the Service at the time you purchase a subscription.

Subscription fees are billed in advance on a recurring basis (monthly or annually). Your subscription will automatically renew unless you cancel before the renewal date. You may cancel your subscription at any time through your account settings.

Refunds are provided at our discretion and in accordance with applicable law. We reserve the right to change our pricing at any time, with notice to existing subscribers.

8. Third-Party Services

The Service may contain links to third-party websites or services that are not owned or controlled by Vocara. We have no control over, and assume no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

9. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected. We make no warranties about the accuracy or completeness of the Service's content.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, VOCARA SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

11. Indemnification

You agree to defend, indemnify, and hold harmless Vocara and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses arising out of or in any way connected with your access to or use of the Service or your violation of these Terms.

12. Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination, your right to use the Service will immediately cease.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Vocara operates, without regard to its conflict of law provisions.

14. Changes to Terms

We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or through a notice on the Service prior to the change becoming effective. Your continued use of the Service after such modifications constitutes your acceptance of the updated Terms.
